Law Society of Kenya Condemns Abduction and Murder of Wajir MCA, Demands Urgent Investigation

NAIROBI, Kenya – The Law Society of Kenya (LSK) has strongly condemned the abduction and brutal murder of Wajir’s Dela Ward MCA, Yussuf Hussein Ahmed, in what the organization has described as a grave violation of human rights and the rule of law.

Ahmed, who was abducted on September 13, 2024, by armed assailants driving unmarked vehicles along Enterprise Road in Nairobi, was found dead two weeks later.

His mutilated body was discovered on September 27 in Lake Yahud, leaving the nation in shock.

The abduction was reported by Ahmed’s family to the Directorate of Criminal Investigations (DCI) under OB No. 86/13/09/2024, but efforts to locate him were futile.

Following the abduction, the LSK, acting on behalf of Ahmed’s family, secured a court order on September 26 directing the Director of Public Prosecutions (DPP) and the DCI to produce Ahmed in court or explain his whereabouts if he was in custody.

However, both agencies failed to comply with the order.

In a statement, LSK President Faith Odhiambo expressed outrage at the murder and called for an independent investigation into the killing.

She urged the DPP to immediately instruct the Inspector General of Police to launch a thorough inquiry into the case, ensuring that those responsible are apprehended and prosecuted.

“We demand an immediate, thorough, and independent investigation into the abduction and murder of Yussuf Hussein Ahmed. The Director of Public Prosecutions must exercise his powers under Article 157(4) of the Constitution and direct the Inspector General of Police to urgently conduct investigations aimed at bringing the perpetrators to justice,” Odhiambo said.

The LSK condemned the murder as a gross violation of Article 26(1) of the Constitution, which guarantees the right to life.

The organization stressed that Ahmed’s death reflects a worrying rise in extrajudicial killings and enforced disappearances in Kenya, adding to growing concerns about the state of law enforcement and accountability in the country.

“The extrajudicial killing of Ahmed is an attack on the rule of law and underscores the urgent need for accountability in such cases. These acts are a stark reminder of the increasing threat to human rights and the impunity that perpetrators enjoy,” the LSK statement read.

Ahmed’s death has drawn widespread condemnation from political leaders and residents of Wajir County, who are mourning his loss and demanding swift justice.

The LSK vowed to support Ahmed’s family in their pursuit of justice and to ensure those responsible are held accountable.
